COMPLIANCE UPDATE: Compensation and Job Description Posting Requirements

As of September 17, 2023, employers in New York State with four or more employees must include the compensation or compensation range for any job, promotion, or transfer opportunity that is posted or advertised, along with a job description if one exists. This mandate extends to internal postings and jobs advertised by third parties, such as employment agencies or recruiters.

What you need to know:

  1. Inclusivity and Transparency: These new requirements are designed to promote inclusivity and transparency in your hiring processes. By including compensation information upfront, you set clear expectations and empower candidates to make informed decisions.

  2. Minimum and Maximum Salary or Hourly Rates: Any compensation range must include a minimum and maximum salary or hourly rate. This range should be provided in good faith, reflecting the lowest and highest annual salary or hourly compensation that the employer believes to be accurate at the time of posting.

  3. Adherence to Regulations: Ensuring compliance with these regulations is not just a matter of legal obligation but also an opportunity to showcase your commitment to fairness and equity in your organization. Failure to comply can result in legal consequences.
